Overview

Welcome to SŌK Defense. The terms "we," "us" and "our" refer to SŌK Defense, a business of Moulder Services, Inc., a North Carolina corporation located in Union Grove, North Carolina. SŌK Defense operates this store and website, including all related information, content, features, tools, products and services (the "Services"). SŌK Defense is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with the policies referenced in them (the "Terms"), describe your rights and responsibilities when you use the Services. Please read them carefully. They include important information about your legal rights, including warranties and limitations of liability.

By visiting or using the Services, or by placing an order, you agree to these Terms, our Legal & Safety page and our Privacy Policy. If you do not agree, do not use the Services.

Section 1 - Who can buy and your account

You must be 18 or older to buy from us. By using the Services or placing an order, you confirm that you are 18 or older.

We sell to individuals, and to law enforcement agencies, government departments, schools, businesses, other organizations and authorized dealers. If you order on behalf of an agency or organization, you confirm that you are authorized to do so. Agencies and departments are responsible for their own use-of-force policies, approvals and training. Dealers may be subject to separate written terms, which control if they conflict with these Terms.

To use the Services, you may be asked for information such as your email address and your billing, payment and shipping details. You confirm that the information you provide is correct, current and complete, and that you have the right to provide it. You are responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell, assign or license your account to anyone else.

Section 2 - Your responsibility to follow the law

Laws on buying, carrying and using defense sprays vary by state, county and city. You are responsible for knowing and following the laws that apply where you live, work and travel, including any limits on container size, who may carry, and where a spray may be carried.

We do not represent that SŌK products are legal to buy, possess or use in any particular place, and nothing in the Services is legal advice.

We do not ship to New Jersey. We may cancel and refund any order we believe would be shipped to, or used in, a place where it is not allowed.

You may not resell or give SŌK products to anyone under 18, or to anyone in a place where they are not allowed. Dealers are responsible for following all laws that apply to their own sales.

Section 3 - Our products

SŌK products are intended only for lawful self-defense and for deterring aggressive animals. Read the label, the Legal & Safety page and the Safety Data Sheet before use.

No self-defense product works in every situation. Results depend on distance, wind, aim, the person or animal involved, and other conditions. We do not guarantee any particular result.

We have made every effort to show our products accurately, but colors and appearance may look different on your screen depending on your device and its settings. Product descriptions may change at any time without notice. We may discontinue any product at any time, and may limit the quantities of any product we offer to any person, region or jurisdiction.

Section 4 - Orders

When you place an order, you are making an offer to buy. We may accept or decline any order for any lawful reason. Your order is not accepted until we confirm acceptance, and we must receive and process your payment first. Please review your order carefully before you submit it, because we may not be able to cancel an order after it is accepted. If we decline, change or cancel an order, we will try to contact you using the email, billing address or phone number you provided.

For orders of more than 50 pieces, please contact us for a shipping quote before ordering.

All sales are final. Returns are accepted only by prior arrangement, as described in our Refund Policy.

Section 5 - Prices and billing

All prices are in U.S. dollars. Prices, discounts and promotions may change without notice. You pay the price in effect when you place your order, as shown in your order confirmation email. Unless stated otherwise, posted prices do not include taxes or shipping.

We may offer promotions that have their own terms. If a promotion's terms conflict with these Terms, the promotion's terms apply to that promotion.

You agree to give current, complete and accurate purchase, payment and account information, and to update it promptly so we can complete your orders and contact you. You confirm that the payment information you provide is correct, that you are authorized to use that payment method, and that you will pay all charges at the posted prices, including shipping and any applicable taxes.

Section 6 - Sales tax

We collect North Carolina sales tax on orders shipped to North Carolina. For orders shipped to any other state, we do not collect sales tax, and you are responsible for any sales or use tax that applies in your state. Tax-exempt agencies and organizations may contact us to provide exemption documentation.

Section 7 - Shipping and delivery

Shipping options, rates and delivery areas are described in our Shipping Policy. Orders over $100 ship free within the contiguous United States. Orders to other delivery areas include the added cost of shipping there. We do not ship to New Jersey.

All delivery times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs or events outside our control. Once we hand products to the carrier, title and risk of loss pass to you.

Section 8 - Warranty and shelf life

SŌK products carry the implied warranties provided by law. No employee, dealer or agent may make any other warranty on our behalf. If a product arrives damaged, defective or not what you ordered, see our Refund Policy.

SŌK has a shelf life of 5 years. Keep it from freezing and store it as described on the label and the Safety Data Sheet. Products that have been frozen, overheated, punctured, altered or stored outside these directions may not perform as intended.

The website itself, and the general information on it, are provided "as is" and "as available." We do not promise that the website will be uninterrupted, timely, secure or error-free.

Section 9 - Limitation of liability

To the fullest extent allowed by law, SŌK Defense, Moulder Services, Inc., Shopify, and their owners, directors, officers, employees, affiliates, agents, contractors, service providers and licensors are not liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, lost revenue, lost data or replacement costs, arising from your use of the Services or any product bought through them, even if advised of the possibility of those damages. Our total liability for any claim related to a product will not exceed the amount you paid for that product.

We are not responsible for injury, loss or legal consequences that result from misuse of SŌK products, from use that breaks the law, or from failure to follow the label, the Legal & Safety page or the Safety Data Sheet.

Some states do not allow certain limits on liability, so some of these limits may not apply to you.

Section 10 - Indemnification

You agree to indemnify, defend and hold harmless SŌK Defense, Moulder Services, Inc., Shopify, and their affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable attorney fees, owed to any third party because of: (1) your breach of these Terms or the documents they include by reference; (2) your violation of any law or the rights of a third party; (3) your misuse of a SŌK product, or your use of it in a way that breaks the law; or (4) your access to and use of the Services.

We will notify you of any claim covered by this section, but a late notice does not relieve you of your obligations unless it materially harms you. We may control the defense and settlement of the claim at your expense, including choice of counsel, but we will not settle a claim that requires something other than money from you without your consent, which you will not unreasonably withhold. You will cooperate in the defense, including by providing relevant documents.

Section 11 - Intellectual property

The Services, including all trademarks, brands, text, displays, images, graphics, product reviews, video and audio, and their design, selection and arrangement, are owned by SŌK Defense, its affiliates or licensors, and are protected by U.S. and foreign patent, copyright and other intellectual property laws.

These Terms let you use the Services for your own non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display or perform, republish, download, store or transmit any material on the Services without our prior written consent. Authorized dealers may use product images and descriptions only as we allow in writing. All rights not expressly granted are reserved.

The SŌK name, logos, product names, designs and slogans are trademarks of Moulder Services, Inc., and you must not use them without our prior written permission. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos and slogans on the Services belong to their respective owners.

Section 12 - Optional tools

We may give you access to customer tools offered by third parties, which we do not monitor or control. We provide these tools "as is" and "as available," without any warranty or endorsement, and we are not liable for your use of them. Any use of optional tools is at your own risk, and you should review and approve the terms on which the third-party providers offer them.

Any new features we add to the Services in the future are also subject to these Terms.

Section 13 - Third-party links

The Services may contain material and links from third parties. We are not responsible for examining or evaluating their content or accuracy, and if you leave the Services to visit them, you do so at your own risk. We are not liable for any harm related to third-party websites, or to products, services or content you buy or use there. Please review the third party's policies before any transaction, and direct any complaints or questions about third-party products to that third party.

Section 14 - Relationship with Shopify

SŌK Defense is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with SŌK Defense. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and SŌK Defense, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with SŌK Defense.

Section 15 - Privacy policy

All personal information we collect through the Services is subject to our Privacy Policy, and some personal information may be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these privacy policies.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services to provide and improve them. Information you submit will be shared with Shopify and with third parties that may be located in other countries, in order to provide services to you. Our Privacy Policy explains how we, Shopify and our partners use your personal information.

Section 16 - Feedback

If you send us ideas, suggestions, feedback, reviews or other content ("Feedback"), you give us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display it in any medium for any purpose, including commercial use. You confirm that you own or have the rights to your Feedback, that you have disclosed any compensation you received for it, and that it complies with these Terms. We have no obligation to keep Feedback confidential, pay for it or respond to it.

We may, but do not have to, monitor, edit or remove Feedback we find unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that violates anyone's intellectual property or these Terms. Your Feedback must not violate any third party's rights, contain unlawful or abusive content, or contain malware. You may not use a false email address, pretend to be someone else, or mislead anyone about the origin of Feedback. You are solely responsible for your Feedback and its accuracy.

Section 17 - Errors, inaccuracies and omissions

Information in the Services may sometimes contain typing errors, inaccuracies or omissions about product descriptions, pricing, promotions, shipping charges, transit times or availability. We may correct them, update information, or cancel orders affected by them at any time without prior notice, including after you have submitted your order.

Section 18 - Prohibited uses

You may use the Services for lawful purposes only. You may not use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any federal, state, local or international law or regulation; (c) to infringe our intellectual property rights or anyone else's; (d) to harass, abuse, threaten, defame or harm any of our employees or any other person; (e) to send false or misleading information; (f) to use material that does not comply with these Terms; (g) to send advertising, junk mail, chain letters, spam or similar solicitations; (h) to impersonate any person or entity; (i) to buy SŌK products for anyone under 18 or for use where they are not allowed; or (j) for any other conduct that restricts anyone's use of the Services, or that we decide may harm SŌK Defense, Shopify or users of the Services, or expose them to liability.

You also agree not to: (a) upload or transmit viruses or other malicious code; (b) reproduce, copy, extract, sell, resell or exploit any part of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm or pretext the Services; (e) use any robot, spider, scraper, data-gathering tool, automated process, AI tool (such as agentic AI) or other automated or manual means to access the Services; or (f) interfere with, bypass or circumvent the security or access features of the Services. We may suspend, disable or terminate your account at any time, without notice, if we decide you have violated these Terms.

Section 19 - Agents

19.1 This section ("Agent Terms") applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using a person's device, without direct supervision.

19.2 No Agent may access, use, or interact with Services unless, at all times, it identifies itself and operates in strict accordance with the requirements in section 19.4 below. In addition, no Agent may access, use, or interact with Services if we have requested that the Agent refrain from accessing, using, or interacting with any service.

19.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with Services.

19.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including the following in the request's user agent string: "Agent/[agent name]"; (ii) not conceal or obfuscate that any access, use, or interactions are from an Agent, such as by (a) mimicking human behavior and interaction patterns, or (b) completing or circumventing CAPTCHAs or measures intended to distinguish computer use from humans; (iii) respond truthfully to any question or prompt seeking to determine if interactions are coming from a human or a computer; and (iv) not circumvent or otherwise avoid any measure intended to block, limit, modify, or control whether and how Agents access, use, or interact with the Services.

Section 20 - Termination

We may end this agreement or your access to the Services, or any part of them, at any time and without notice. You remain responsible for all amounts owed up to and including the date of termination.

These sections continue to apply after termination: Following the Law, Warranty, Limitation of Liability, Indemnification, Intellectual Property, Feedback, Termination, General Terms, Governing Law, Privacy Policy, and any other provisions that by their nature should survive.

Section 21 - General terms

Severability. If any part of these Terms is found unlawful, void or unenforceable, it will still be enforced to the fullest extent the law allows, and the rest of these Terms will remain in effect.

Waiver and entire agreement. If we do not enforce any right or provision of these Terms, that is not a waiver of it. These Terms and the policies we post on this site are the entire agreement between you and us about the Services, and replace any earlier agreements, communications or versions of these Terms. Any unclear wording will not be interpreted against the party that drafted it.

Assignment. You may not transfer or assign these Terms or your rights or obligations under them without our prior written consent. We may transfer or assign them without consent or notice to you.

Headings. Headings are for convenience only and do not limit or affect these Terms.

Section 22 - Governing law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Iredell County, North Carolina, and you agree to the jurisdiction of those courts.

Section 23 - Changes to these Terms

You can review the current version of these Terms at any time on this page. We may update, change or replace any part of these Terms by posting changes on our website, and the "Last updated" date at the top shows when they last changed. We will notify you of material changes as required by law. The version posted when you place an order applies to that order, and continuing to use the Services after changes are posted means you accept them.
